How Long Will it Take to Get a Restraining Order?
Generally, the court must issue or deny temporary restraining orders on the same day that the request was filed. (Or, if the request was filed too late in the day for effective review, the order must be issued or denied on the next day.) (See California Family Code, Section 246.) If the judge feels the situation is not urgent and so does not issue temporary restraining orders right away, the court will schedule a hearing to consider the matter. The hearing to decide whether or not the court will order “permanent” restraining orders (5 years) should be scheduled within 21 days from the date that the request was filed.
